  • are resident in the United Kingdom; and

The Promoter reserves the right to request satisfactory proof of age, identity and residency at any
time. Failure to provide such evidence within a reasonable period may result in disqualification and
forfeiture of any Prize.

1.2 Excluded Persons

Unless expressly stated otherwise, the following persons are not eligible to enter a Prize Draw:

  • members of their immediate family or household; and

  • used automated software, bots, scripts or any artificial method of entry;

  • acted fraudulently, dishonestly or in a manner likely to undermine the fairness or integrity of
    a Prize Draw; or
  • otherwise obtained, or attempted to obtain, an unfair advantage over other Entrants.

 

Where this clause applies, the Promoter may declare affected entries invalid and, where permitted by law, no refund or compensation shall be payable.

The Promoter’s decisions regarding eligibility, entry validity and compliance with these Terms and Conditions shall be final, provided those decisions are made reasonably and in accordance with applicable law.

2.5 Right to Refuse or Cancel Entries

Where an entry is cancelled under this clause, the Promoter shall determine, acting reasonably and in accordance with these Terms and Conditions, whether any refund or Account credit is appropriate.

2.6 Governing Law

These Terms and Conditions, together with all Prize Draws operated by the Promoter, are governed by the laws of Scotland.

Any dispute arising out of or in connection with these Terms and Conditions or any Prize Draw shall be subject to the exclusive jurisdiction of the Scottish Courts.

3. Entry Requirements

4. Prize Draws

4.1 Winner Selection

Unless otherwise stated on the relevant Prize Draw page, each Prize Draw will close on the published Closing Date.

Following closure, the winning entry will be selected at random from all valid entries received before the Closing Date using an independently operated random number generator or other independently verified random selection process determined by the Promoter.

The Promoter’s decision regarding the outcome of a Prize Draw shall be final.

4.2 Live Draws

To promote openness and transparency, Prize Draws may be streamed live through the Website and/or the Promoter’s official social media channels.

The absence, interruption or failure of a live stream shall not affect the validity of any Prize Draw or its result.

4.3 Technical or Administrative Errors

If a technical failure, administrative error, human error or other unforeseen circumstance materially affects the integrity or fairness of a Prize Draw, the Promoter reserves the right, acting reasonably, to:

  • suspend the Prize Draw;
  • postpone the Prize Draw;
  • cancel the Prize Draw;
  • rerun the Prize Draw; or
  • conduct a replacement draw using the same Prize or, where this is not reasonably possible, a Prize of equal or greater value.

 

The Promoter will only exercise these rights where reasonably necessary to preserve the fairness and integrity of the Prize Draw.

4.4 Winner Notification

Winners will be contacted using the contact details held within their Account.

Entrants are responsible for ensuring those details remain accurate and up to date.

The Promoter accepts no responsibility where a winner cannot be contacted because inaccurate or outdated information has been provided.

4.5 Prize Claims

If a winner:

  • cannot be contacted within fourteen (14) days of notification, or such longer period as the Promoter may reasonably allow;
  • declines the Prize;
  • fails to respond;
  • fails to satisfy the eligibility or verification requirements contained within these Terms and Conditions; or
  • otherwise fails to claim the Prize within the period specified by the Promoter,

 

the Prize shall be deemed forfeited and the Promoter may select an alternative winner using the same random selection process.

4.6 Verification Before Award

The Promoter reserves the right to delay the award of a Prize while carrying out reasonable verification or investigating any suspected breach of these Terms and Conditions, fraud or other activity which may compromise the integrity of the Prize Draw.

4.7 Publication of Results

The Promoter may publish Prize Draw results, winner announcements and Prize information on the Website and official social media channels.

Publication of personal information will always be carried out in accordance with applicable law and the Promoter’s Privacy Policy.

4.8 Marketing Communications

Entrants may choose to receive communications relating to future Prize Draws, promotions, offers and company updates.

4.9 Amendment or Cancellation of a Prize Draw

The Promoter reserves the right to amend, suspend or cancel a Prize Draw where reasonably

  • circumstances beyond its reasonable control;
  • legal or regulatory requirements;
  • suspected fraud or abuse;
  • technical failures affecting the integrity of the Prize Draw; or

5. Prizes

5.1 Prize Details

The Promoter makes reasonable efforts to ensure that all Prize descriptions, images and specifications are accurate at the time of publication. Images are for illustrative purposes only and minor variations in colour, specification or presentation shall not invalidate a Prize Draw.

5.2 Prize Availability

All Prizes are offered subject to availability.

If, due to circumstances beyond the Promoter’s reasonable control, a Prize or any material element of a Prize becomes unavailable, the Promoter reserves the right to substitute it with a Prize of equal or greater value.

Any substitute Prize shall, as far as reasonably practicable, be of a similar nature.

5.3 Prize Conditions

  • Prizes are non-transferable;
  • Prizes are non-exchangeable;
  • no cash alternative is available; and
  • Prizes must be accepted as awarded.

 

5.4 Cash Alternatives

Where a cash alternative is specifically offered, the winner must confirm acceptance in writing within seven (7) days of notification.

Once accepted by the Promoter, the election to receive the cash alternative shall be final unless otherwise agreed by the Promoter.

5.5 Delivery

Unless otherwise stated, delivery of Prizes is included within mainland United Kingdom.

Additional delivery charges may apply to non-mainland United Kingdom destinations. Where this applies, the winner will be informed before delivery arrangements are finalised.

The Promoter will use reasonable endeavours to arrange delivery within a reasonable period but accepts no responsibility for delays caused by manufacturers, suppliers, couriers or other third parties.

5.6 Ownership and Risk

Ownership of a Prize passes to the winner upon successful delivery or collection.

From that point onwards, the winner is solely responsible for the Prize, including (where applicable) its insurance, registration, licensing, maintenance, storage and ongoing use.

5.7 Taxes and Other Costs

Unless expressly stated otherwise, winners are solely responsible for any taxation, reporting obligations or other costs arising from the acceptance, ownership or use of a Prize.

5.9 Prize Acceptance

The Promoter reserves the right to require a winner to sign a receipt or acknowledgement confirming acceptance of a Prize upon collection or delivery.

5.10 Refusal of a Prize

If a winner refuses a Prize after being confirmed as the winner, the Prize shall be deemed forfeited unless the Promoter, acting reasonably, determines otherwise. Where a Prize is forfeited, the Promoter may select an alternative winner using the same random selection process.

6. Winner Obligations

6.1 Verification

Before a Prize is awarded, the Promoter may require a winner to provide satisfactory evidence of:

  • identity;
  • age;
  • residency;
  • eligibility to enter the Prize Draw; and
  • any other information reasonably required to administer the Prize Draw or comply with legal
    or regulatory obligations.

 

Failure to provide the requested information within a reasonable period may result in disqualification and the selection of an alternative winner.

6.2 Identity and Fraud Checks

6.3 Collection or Delivery

Where a Prize is delivered, the winner must provide any reasonable information required to facilitate delivery.

Failure to collect or accept delivery of a Prize within a reasonable period may result in forfeiture of the Prize.

6.4 Publicity

The Promoter may invite winners to participate in reasonable publicity relating to their Prize or the relevant Prize Draw.

Participation is voluntary unless otherwise required by law.

A winner may decline publicity by notifying the Promoter before publication wherever reasonably practicable.

9. Refunds

9.1 General

All Prize Draw entries are final.

Where the Promoter determines that an error has occurred as a result of its own systems or administration, it may, acting reasonably and at its sole discretion:

  • provide an Account credit equal to the value of the affected entry;

9.3 Duplicate Payments
